Project General Description

The Institutional Support project to the Common Court of Justice and Arbitration (CCJA) is part of the efforts at strengthening and harmonization of business law in Africa and thus contributes to legal integration of the member countries. The CCJA is a regional, economic and legal integration institution established to play a pivotal role in the functioning of the Organization for Harmonization of Business Law in Africa. The project addresses the current constraints on the functioning of the CCJA, particularly, the insufficient human and financial resources, the limited extension of the OHADA Uniform Acts, and the lack of specialization in community business law and the attendant limited participation of the professionals concerned. The institutional strengthening of CCJA will make for greater efficacy and celerity in the processing of cases submitted for dispute settlement or arbitration procedures, and will support good judicial governance and help win the confidence of private investors. The three project components are: (i) Building CCJA capacity; (ii) Communication and dialogue; and (iii) Support to project management. The total cost, net of duty and taxes, is estimated at 840,900 Units of Account for an execution period of 24 months.

Project Objectives

The sector objective of the project is to create guarantee legal security for business transactions, encourage investment and ultimately foster regional integration. Its specific objectives are (i) assist the CCJA to effectively and expeditiously deliver its opinions, rulings and decisions on matters within its jurisdiction; (ii) provide the basis for credibility of Common Court of Justice and Arbitration decisions by promoting an understanding of its procedures amongst the parties concerned.

Beneficiaries

The seven judges who are members of the CCJA are among the direct beneficiaries of the support expected from the project. The project will also offer the Department of Finance and Accounting (DFC) the means to improve its capacities for programming, management and follow-up of CCJ activities. The Documentation Center will further be reinforced, so as to extend the Uniform acts and CCJA decrees and decisions to economic operators and national jurisdictions of the member countries.
