Project General Description

The present project of computerization of the regional file of the Register of Commerce and the Furniture Credit (RCCM) of the Organization for the Harmonization of the Business Law in Africa (OHADA) was initiated by the Common Court of Justice and Arbitration CCJA-OHADA with the support of the African Development Bank Group through a grant from the African Development Fund (ADF). It should make it possible to guarantee rapid, accessible, sincere and centralized legal information on merchants, companies, as well as on securities and furniture loans. This innovation is consistent with the need to address the shortcomings and operating difficulties that affected the RCCM. This computerization project of the regional RCCM is part of a modernization framework which must take into account: on the one hand, the achievements in the field of computerization in some advanced countries in this field and, on the other hand, the needs of necessary harmonization of regional RCCM and national RCCM not yet computerized or in the process of computerization or already computerized.

Project Objectives

The main objectives of the computerization project are: (a) securing existing and future national RCCM data; (b) Data accessibility to different user groups; c) the reliability of consolidated data from national RCCMs; (d) the dissemination and real-time availability of the recorded data; e) the production of regular statistics for monitoring the evolution of the RCCM; f) the respect of the commitments of the member countries vis-à-vis the OHADA; (g) the legal validity of the electronic data; h) recovering existing data in paper formats.

Beneficiaries

The main beneficiary of the project is the Organization for the Harmonization of Business Law in Africa (OHADA).
